The problem is this is REAL.

I put a thread up on prodj.com

I just got a PM from the moderator. Take a read.

"Hi Stan

We have been asked by the attorney to remove any posts regarding this lawsuit and we feel it is in the best interests of everybody to do so.

If I were to give you my opinion of the lawsuit, it would require several emoticons at the least.

The ProDJ mod does have a point, even if it's only to avoid an additional lawsuit.

The decision to remove this thread here, against your wishes, will be CJ's.

On the other hand, a moderator here, I can remove this thread. If you see the ProDJ mod's point, and want it removed from here, CJ or I will do it as soon as one of us see your reply.

I don't see where there is the potential of a lawsuit. Why can't there be an open discussion of the matter. Since when does an attorney have the right to shut down free speech? Where is the legal precidence for stopping a discussion about this?

The problem, as I see it, is this: This DJ is suing all the other DJs that use "music" and "master" in their websites. Yet the words "master" (as in "master of ceremonies") and "music" would be extremely difficult to NOT use in a DJ website.

Seriously, how does one describe one's DJ business without using the word "music"? Oh, I suppose a person could find ways around it, but the result would probably be pretty awkward, and the idea of not being allowed to use that word when that's the primary mechanism though which we perform our duties seems completely ridiculous to me.

The real problem here is that Andrew Byrd of "MusicMaster Disc Jockeys Inc." didn't choose a very good name for his company. Certainly not a unique one, anyway, and the result of his poor choices is that the search engines are penalizing him for it. And for him to further claim that "he has the right to be the ONLY DJ IN ATLANTA to be able to advertise that he offers: "disc jockey services" and "wedding entertainment"... " is beyond completely unreasonable.

The Trademark and Patent Office also appears to have dropped the ball on this, big time. Perhaps some other DJ should hurry up and get exclusive rights to the phrase "disk jockey" and sue the rest of the country. :roll:

Hmmm... this one's a tough one. Discussion about anyone's trademarked name is not illegal. (Freedom of speech.) The only folks that should be concerned are those trying to use those trademarked phrases in reference to their own business.

As for the trademark:
When did he file for it?
The trademark office will drop it if anyone can prove prior use...

Here's my take on this matter:

The Golden Rule applies: "he who has the GOLD, makes the rules"

(hey, that sounds like it could be CJ's motto!)

what I mean is: IF the DJ with the Attorney has deep pockets, they will be able to steamroll over Todd's web site client.

Did anyone else scroll down to the part where Todd is claiming a racist motivation for the lawsuit?

This is going to be happening all the time if Barack Obama becomes president.

whenever a black person is sued by a caucasian, they can cry "Racism!"

What the heck does that have to do with Obama being elected? In what way is this different from today? In what way is the opposite not also true? Sorry, but I call bu11sh1t. People can, and do, sue other people for stupid reasons, and describe their motives however they want.

Let's stay on topic, people.

UPDATE

Yesterday, it was announced that WeDJ.com has purchased FDJA from Todd Donald.

Todd will be using the $$ from this sale to pay for his legal defense!
